The Employment Appeal Tribunal Judge Mr Singh, recently confirmed in Lock v British Gas (2016) case that when calculating holiday pay under the Working Time Regulations, in compliance with the Directive, staff are entitled to have their holiday pay calculated in exactly the same way that their pay would have been calculated if they were working; accordingly commission should be included in the holiday pay calculations.
